    Hi All <!channel> I have similar question to Annabel, but related to client contracts. Which depertant should really own contract signing? Would the the best practise be for this to sit with sales department? They close the deal, get contract out and pass it on to onboarding team, passing only closed deals?

We are having some issues with lots of people WFH - to the point where it's impacting our ability to get work done. Would love to hear if anyone has similar struggles/has managed to change to a less flexible policy! (Hope this doesn't sound too harsh)! 😬

    Hey team <!here>: Who's been missing the Data Protection Acts chats? Put your hands up, not all at once! I would like feedback on how we decided to position ourselves as a Processor vs Controller. I am currently getting pushback from a potential client and want to ensure my understanding is clear and solid as a rock(et) 🚀 We position ourselves as Data processor and they think we should be the Data Controller. We are a B2B HR tool to manage professional development so take the employee data we are given from the employer in order to provide our services. We have not had this issue with any of our other clients inc. corporates. Does of you guys and gals act as Controllers or are all Processors? Have you experienced similar push back and if so how did you respond?

    @wooden-appointment-3216 I know at DICE we were both and for Learnerbly I’d also argue that you’re both...but it’s also been a while since these convos. Do you have a DPO and did you get external advice previously?

    We are both depending on who the relationship is with. In this instance, the client is arguing that we should be a controller in our relationship with them (so that we have the highest level of responsability, ofc...) and we are arguing (our original position) that we are a processor. Our stand: The client owns the data of their employees (controller) and we humbly use it to purchase resources on their behalf (processor). Their stand: The client provides the data so that our company can perform its own purpose, the service we provide, which therefore makes us a controller.

    I agree with @gray-crowd-13635 here. The scope of your control (pun intended) is defining your role. As a service provider, you are limited to using the employee data given to you by the employer (your client) to deliver your services and not beyond. You are not allowed to pass that data on to anyone besides partners that are part of your third-party agreements, you are not allowed to publish it and most importantly (imho) you have no direct consent from the data subject (employee) as you are not collecting the data, that is done by the hr staff of the client
