I have a unique payroll query again related to different entities with in a same company.One of our ex employee has spent 5 years in total with 3 years in one entity of the company and rest 2 years in a different entity under the same umbrella org.Now post her exit, i need clarity for calculating her gratuity-Is she eligible for it as her salary was processed with 2 different entities in this time period. And secondly, how will it be calculated?

This one is tricky because technically it is considered as a separate job all together. However if let's say the employee has been given a transfer letter and saying continuity of services then yes, otherwise legally no implications since there are 2 separate PF contributions there is no continuity of services for 5 continuous years.

So just got to know in her case, PF was from one account only

Then it's a continuous service for 5 years in this case gratuity will be applicable
