Hi Team, if an employee resumes from maternity leave, will her increment be effective from April or the month she resumes work?
k
depends on company cycle / I don’t think any law is there
j
we follow April to march cycle. she resumed work in August.
k
ah I see / yes then it has to consider the months she was on leave as well as thats earned leave

minimum of 6 months is considered for salary appraisal. You can have a performance review but no salary revision if they have worked less than 6 months. But then have a policy written and explain to them why 6 months minimum is required. If your company has quarterly formal performance reviews then go with 3 months instead of min 6 months
s
if its apr ro march cycle, applicability should be from 1st Apr (like all other employees covered in cycle) as she was on approved leaves which translated into her active working

Maternity leaves should not be treated in any manner as absence from work. If the employee falls under merit increment cycle she has to be considered for increment. However for such instances good pms policy will cover deflated increment keeping in mind inflation rate. If you have a policy plz do a specific deflation increment clause which can cover such cases similar to maternity or sabbatical leave on a medical basis. Please do not spare a reason basis maternity while increment as it may lead to policy violation towards equal remuneration act

@Jasmeet Dhanjal as per previous cases, the increment is to be given as per the cycle, from the uniform date of increment.

@Nirzari Sen can you please share more light on Deflation increment clause .How it is calculated ?
n
@pallavi sure. Deflation increment clause is such a clause which is inserted in the compensation policy aiming at giving inflation increment for such cases which are not completely utilized at work despite of fulltime employment. We consider those cases who are in sabbatical , medical or study leave , maternity cases. We explicitly do not use this term however the clause would reflect the intent of appraising the employee with basic minimum deserving increment.
