Hi everyone, if an employee who is eligible for 6 months leave under Maternity Benefits Act decides to not take the 6 month leave and instead join back within 2/3 weeks of childbirth, what are the necessary steps that we need to take as an employer.

You need to take an written note/mail that she is joining early by her own accord, no pressure/threat has been created by the company

Also, advised, ask her to get a fitness record by her doctor

Please record the following in writing and wet ink from the female employee returning to work mid of maternity leaves:
⢠consent on wilful joining
⢠fitness medical certificate
⢠(any) needed planned leaves/work break
⢠any other support required

It is important to understand why the employee is planning to return within 2-3 weeks? There is a reason the law has been changed to 6 months from earlier 3 months. Please enable your employee with all the necessary information before taking a decision.
