@Harender Bisht Both the letters an be withdrawn from a candidate. The legal consequences are determined by the clause mentioned in these letters.

Thank you @Wristy Can a candidate claim any compensation after withdrawing the offer. The candidate didn't match all the criteria required for hiring & the Background Check & Employment Check got failed.

It would be helpful to know if the withdrawal condition was mentioned in the letter.

"Your appointment will be confirmed subject to verification of your testimonials & reference checks. Any kind of misrepresentation of facts automatically disqualifies you for confirmation/continuation of appointment with this company without any compensation thereof." For your reference purpose.

Thanks. In this case, notify the candidate and give them the opportunity to respond to what was not cleared in the background check. The letter may be withdrawn based on the response. Furthermore, given that you have mentioned ‘without any compensation thereof’ in the letter, no compensation can be requested. However, the candidate is free to go to court - in India, everyone has free will. 😄
