Inspired by above, this is a question I was wondering about for a while. Considering that 1099 has double the FICA taxes and there is a max income for FICA taxes (you don't pay over a certain amount). Which takes precedence, the w2 or 1099? As in the above example 180k is above the limit for social security, would they be paying the double FICA for the 1099, or the w2 comes first and they pay no FICA for the 1099?

This is a great question ๐Ÿค”

I'd imagine the w2 takes precedence because the employer already paid the other half.

What if someone has 2 employers and goes over the limit. Which employer saves the extra? Who figures it out?

^ Thats an interesting question

IIRC, the max only applies to the employee half, not the employer
No, I got that wrong - it applies to both halves
@nutritious-raincoat-28876 the consensus online appears to be that both employers lose out - both have to fully fund the SS withholding and neither can ask for a refund if it goes over the cap.
@curved-toothbrush-84425 for people getting both w2 and 1099s, it appears the w2 comes first

Yeh I was just wondering if each employer basically has their own obligation to pay up to the max for SS and so it wouldn't matter if there were 2 employers

This is consistent with what my accountant has been doing for me for years

Thanks!

@rich-notebook-17814 wow, classic government. But it's a sticky edge case, so I can't really fault them
