Hey Everyone, I have an employee who is not ready to serve the notice period, has resigned & now is not responding to any calls or msgs or emails. He was into a bond with the company & he has tenure till September 2023 or else he has to pay back the amount. Now the challenge is, the employee is not responding to us, as I mentioned above as well. What action/ step is to be taken in this , kindly help .

Depends on how much you want to pursue this. For starters, it might just be a good idea to send him a strongly worded letter (by post) as a notice that he is in breach of contract and the action you expect him to take. That way, if you do decide to go legal, you will have the right paperwork.

Please issue a Show cause notice, stating the absence from the duty without any intimation, you can get sample online.

Usually after a first intimation of the absence from the duty, they tend to respond back immediately. Send it through speed post explaining the clauses in the letter well

@Shivanshi Khanna would recommend to send any communication via registered post, which in turn gets acknowledged by the concerned receiver that it has been received. which will also act as a proof of evidence in case it goes legal.
