They've put it there to avoid confusion with users running a properly licensed VPX, as they don't need to update. Can agree on that decision, although it is not ideal.

Richard with HA sync I've also seen issues before where the SSL profiles used by internal services doesn't match up (back end SSL profile on the source NetScaler doesn't have a compatible ciperh/protocol etc on the front end profile of the target NetScaler). Usually this is on older builds that have been upgraded, not on a fresh build but might be worth checking.
