Related to the above conversation about remote companies and Upwork. What are the legal aspects of hiring a remote worker in India by a company abroad say the USA? I had a thought about this from some time and started looking online for some information today. It would be great if community members can share their experience. It seems that companies can not directly hire a remote worker on a payroll basis. The company should Register In-Country or hire the employee through a third party. The company have to set up a way to run payroll in the country of the worker. I watched a video about elastic (shared on another channel) and it was mentioned the company hired CFO first so they can hire remote workers from anywhere in the world. Therefore sometimes it is mentioned on remote job posts, the company is hiring only in the 1-2 countries. The easiest option for a company is to hire remote Independent contractors. Therefore platforms like Toptal, Upwork makes it easier to hire remote workers. A remote contractor can be working on the same things as the employee in the office. But the legal status will be a contractor. A company can be willing to hire people on the payroll but due to legal issues, it is easier to hire contractors. leading companies in the remote (I know Invision does this for sure) actually hires people on payroll instead of a as a contractor. Yes, it's a big headache for the companies and but fully distributed companies are willing to take-on this headache because great talent comes with great expectation šŸ˜‰

I’m not sure about bank account opening and taxation if they hire international employees on payroll. I have worked with many fully distributed companies and every employee seems to be working on contract role.

Yeah, Likewise - been with fully-distributed teams for past 3 years and all of them were as contractors only. I have a friend who works at Invision - They provide health-care, 401 alternatives and other benefits depending on your employee resident companies. It's not something that everyone does (even automattic hires as contractors only) but it seems like a great gesture from Invision's behalf.

Only big remote companies have the resources to give employee status on paper. It does not matter from the work part but some people prefer employee status. Working with two companies and both only hire remote contractors. Also, in the tech sector, most companies prefer skills than contractor vs employee while hiring.

Ok, I think, I'm most qualified to answer this query. Because I'm working in this setting from last 1 year or so. There is something that is called PEO that remote work company engages and he will be your reference for all HR matters, they get guidance via your original employer. I'm happy to share more details about PEOs but it is crappy thoigh (frankly!)
