Yes, both are still applicable.
For the first one, we have a candidate fix, with quite some impact, here: https://github.com/gradle/gradle/pull/38077
For the second one, we effectively are breaking Android 8.x compatibility. Users should not upgrade beyond Gradle 9.5.1 until they upgrade to Android 9.x itself.

Yup but this candidate is scheduled for 9.7, not 9.6.x, that's why I was looking for this, Originally I didn;t pay attention, but a colleague thought it was fixed in 9.6.1 , because it dint appear in the know issues (I know it doesn't appear either in the fixed ones).

That was a labelling issue, they should show up next time docs are deployed (usually happens at least daily)
