I spent some time with that part of code and to be fair it's a pretty bad hack, which we took part in creating 🙂 I hope GitHub will soon fix it with Rulesets and we would be able just to ask GitHub whether atlantis is allowed to merge a PR. I have added a comment to your PR as well.

yeah I noticed that dealing with the check suites endpoint is a bit complicated, so I didn't dive in that thoroughly. I hope so too 🙂
