(we had both), otherwise atlantis would not run

There is a flag to exactly avoid 🥚🐔 problem - https://www.runatlantis.io/docs/server-configuration.html#gh-allow-mergeable-bypass-apply. However, it only works if you are using branch protection and not Rulesets and if you have relatively simple branch protection
