Summary of the new Apify terms and conditions for creators: Apify’s new Store terms The main change is that you are now clearly the provider of your Actor, while Apify is only the marketplace/platform. A default contract automatically exists between you and every user unless you publish your own terms. Legal/compliance: - User claims about the Actor go to you, not Apify. - The default contract limits your liability to USD 100 in most cases and includes strong “as-is” warranty disclaimers. - If the Actor processes personal data, you may be the user’s data processor. You must secure it, control subprocessors, support deletion/return and data requests, and permit reasonable compliance audits. - For qualifying AI Actors, you warrant compliance with the EU AI Act and other laws. **Money**: - Standard payout remains 80% of Actor fees minus applicable Apify platform costs. - You pay all third-party costs, including AI models, data providers, proxies, etc. Price carefully and add usage limits so heavy users cannot make your Actor unprofitable. - Console profit estimates can change due to refunds and unpaid invoices. - No payout while an Actor is classified as faulty. - Apify can withhold or reclaim revenue linked to fraudulent/unpaid users. - Review monthly invoices within 3 days. - Unpaid balances below the minimum or blocked by incomplete KYC are forfeited after 12 months. - Promotional-credit users are paid using your highest configured unit price, which seems favorable. Operations/enforcement: - User issues: respond within 14 days. - Apify requests: respond within 3 business days. - No off-platform payments, unauthorized promotion, review manipulation, copied listings, or misleading branding. - For a breach, Apify may take up to your full unpaid balance as a contractual penalty and may still claim further damages. - Apify may use your Actor, name, and logo in marketing and case studies. - A future Partner Creator tier may offer distribution/benefits, but access and economics are not guaranteed. Bottom line: the 80% share remains, but you now carry clearer responsibility for customer contracts, privacy, AI compliance, support, and outside API costs. Audit margins and data handling first. thanks! I had just read through them myself. btw, is it possible to see what actually changed - I think many of these items have been around before. I just don't know if they were never written down at all or I just never came across this page yet.

Here are the changes 😄 Apify Store Terms Update — Exact Changes This compares the February 20, 2026 terms with the September 2, 2026 terms. It lists only changes. Creator program - Apify added Unverified Creator, Verified Creator, and Partner Creator levels. - Partner Creators need KYC, good Actor Quality Scores, set service levels, no open compliance case, and a separate agreement. - Apify does not promise Partner status and may change the rules with notice. - Partner Creators may get sales support, benefits, and a different payout plan. Users and legal duties - You now provide the Actor to users directly. Apify is not part of that deal. - The new Standard Actor Contract applies by default. - You may use your own End-User Terms, but they cannot give users less protection. You must tell Apify first. - You promise that you can follow these terms, including data-protection duties. - The Standard Actor Contract adds rules for personal data, subprocessors, audits, data deletion, the EU AI Act, warranties, liability, and disputes. Costs and pricing - You must pay all third-party service costs, such as AI APIs, data providers, and proxies. Your price must cover them. - The fixed list of pricing models was removed. You may now use the models shown in Apify Console. - Apify added customer discount tiers. Higher-spend tiers must have the same or a lower unit price. - A user’s tier uses their total Apify spend, not only spend on your Actor. - Apify may change tier limits with notice. - The payout rule is now 80% of Actor fees minus configured Platform usage costs. - For Promotional Users, payout uses your highest unit price, even if they paid less or used credits. Actor rules - The required “unofficial” label for third-party services was removed. Branding must still follow the law and must not suggest approval or affiliation. - The copying ban now names code, READMEs, descriptions, and other content. - Apify may act against an Actor without notice. - You must answer any direct Apify request within three business days. Before, this applied only to emails marked “urgent.” - A late reply may lower the Actor Quality Score. Rights and penalties - Apify may use your Actor in ads, partner programs, sales material, coupons, and discounts. - Apify may use your name and logo in campaigns, sales decks, and case studies. - You promise that you own all rights needed to give Apify this license. - The old broad payout-loss rule was replaced. Apify may now charge a contractual penalty for breaking the Publishing Terms, capped at your unpaid balance. It may also seek extra damages. - The terms now state Czech law, severability, and no agency or employment relationship.

Thanks for the summary! Does any of these address the issue, which actors are intentionally priced extremely low (eg $0.01/1000) to game the ranking in Apify store? We discussed these couple weeks or months ago

It sounds like the part about payout-loss helps to address that. I guess we would need to wait a few months and see if it has an impact...
